3. SICK LEAVE: Effective January, 1 2018:
Starting January 1, 2018, Washington State employers are required to pay staff sick leave as follows:
Accrual of leave: Employees are entitled to at least 1 hour of paid sick leave for every 40 hours worked.
Employers may also provide paid sick leave in advance of accrual provided the front-loading meets or exceeds the law’s accrual, use, and carryover requirements.
Paid sick time (PST) will begin to accrue on January 1, 2018, or the beginning of employment, whichever is later. New hires may be required to wait until 90 days after hire before using accrued leave.
Use of leave: Leave may be used:
• For absences resulting from an employee’s mental or physical illness, injury, or health condition; to accommodate the employee’s need for medical diagnosis, care, or treatment of a mental or physical illness, injury, or health condition; or an employee’s need for preventive medical care;
• To allow the employee to provide care for a family member with a mental or physical illness, injury, or health condition; care of a family member who needs medical diagnosis, care, or treatment of a mental or physical illness, injury, or health condition; or care for a family member who needs preventive medical care;
• When the employee’s place of business has been closed by order of a public official for any health-related reason or when an employee’s child’s school or place of care has been closed for a health-related reason; and
• For absences that qualify for leave under the domestic violence leave act. Employers may also allow employees to use paid sick leave for additional purposes.
Family members. The law defines “family member” broadly and includes:
• A child, including a biological, adopted, or foster child, stepchild
4. LOA and MILITARY LEAVE
A leave of absence is time off in a non-pay status. Upon receipt of a formal written request for leave of absence from regular full-time employees, management will determine whether a leave of absence will be granted. (Also see Medical/Family Leave policy.)
The employee is expected to request leave of absence with as much advance notice as possible. Leaves of absence will not be granted for periods less than two weeks in duration. Vacation or sick leave should be used for such absences.
The reason for leave should be for personal or military reasons.
a. MILITARY:
— To protect the employment rights of employees entering the armed forces of the United States and to ensure conformance with the applicable federal laws, a leave of absence must be granted to all employees, except temporary, who enter military service for active duty as a result of the following:
Initial enlistment in the armed services of the United States;
Initial training period in the National Guard;
Being ordered to active military service, as a member of the Reserves or National Guard for an indefinite period or for a periodic training period up to ten working days; and any service requirements under the Selective Service Act.
